Representative Litigation Matters
- Represented homeowner and prevailed on claims against insurance company and homeowner’s association after fire destroyed their home and the insurance company wrongly refused to completely rebuild as required by the insurance policy purchased by the association for the benefit of owners;
- Represented owner of a multi-million dollar luxury home in North Raleigh in litigation involving claims of negligent construction, breach of contract, warranty, professional misfeasance, and unfair and deceptive trade practices, and resolved the dispute favorably for the benefit of the home owner in mediation resulting in buy-back of defective home;
- Represent shopping center, office, and warehouse landlords as well as tenants in lease dispute cases, including eviction and lease enforcement matters;
- Brought suit against local government for denial of developer’s rezoning application and secured favorable rezoning on behalf of client as a result;
- Represented Shopping Center developer in trial court and at Court of Appeals and defended development permits issued by Town against neighborhood and community opposition groups seeking to have permits invalidated;
- Represented landowner in a lawsuit against Town in a successful effort to secure rezoning of property for residential and business uses;
- Represent real estate developers and owners in appeal of variance denials in Superior Court;
- Represented Home Builder clients in contested case actions in the Office of Administrative Hearings and successfully challenged adverse environmental permit decisions by Department of Environment and Natural Resources;
- Represent property owners in condemnation actions and proceedings;
- Advise home owners associations and members relative to a broad range of planned community issues and homeowners association disputes;
- Represent businesses and individuals in collection and judgment enforcement actions.
